You Tell Us: Can California’s Workers’ Comp System Be Fixed?

    Only when people realize personal responsibility will workers compensation go away. Oh wait, this is California. That will never happen. When someone takes on a job, they should know the risks associated with that job, if they get hurt on the job, they should have health, disability and life insurance they have purchased themselves taking care of it. If they’ve chosen to be irresponsible, they are on their own. If the employer is actually liable for their injury, let the health, life and disability insurance companies recover the money from the employer. That’s personal responsibility.

      Take away Work Comp and then you also take away the “exclusive remedy” which means all injuries will then be taken to court under the General Liability policies. Further clogging the court system and driving up the cost of GL policies. I know GL excludes employment related injuries, but business owner’s are going to demand coverage from some place and with Work Comp, at least it is somewhat predictable what the costs may be but under GL it may not be so predictable. Work Comp isn’t pretty but it does work.

    I agree with reality check, and by the way why do we need an applicants attorney, this is suppose to be a no fault system, they have not been allowed to feed at the trough since Arnold cut them out. They want in very badly, who needs them and don’t tell me the insurance companies don’t pay I can show you lots of payment. If the benefits go up and the rates don’t go up appropriately then guess what we will be with maybe 2 compaines left. These companies are not from the benevolent society, they have stockholder to answer to.

      I hear it all the time. Injured’s always claim insurance deny, deny, deny. Yet about 2/3 of the treatment requests get approved immediately. A good portion of the rest gets approved after receiving more information. A very small number of requests are outright denied and never provided. Also a very small number of claims are denied outright.

      I also hear from employers that all insurance does is pay, pay, pay and never investigates injuries. This makes no sense because insurance works by taking in premium and spending nothing on claims. Those are the most profitable policies. Paying claims, then increasing premiums later does not work. The policyholder can switch insurance and pays the increased premium to the new company, not the old.
