      nah, 3 cold meals and a blanket on the floor. Might try to sue the state for burns caused by “hot” food, or for falling out of bed.

    Can someone explaim to me how going though a McDonalds drive thru constitutes a wc injury?

      I used to have to get coffee for my boss every morning. Maybe that was part of her job to pick up coffee for the boss on the way in to work?

      This wasn’t a workers compensation claim, it was a liability claim.

      How about this?
      (1) Employee is on temporary out of town assignment and getting breakfast. Might be considered course and scope.
      (2) State has a broad definition that includes commuting as course and scope, particularly if work related activity occurred first.
      (3) Employee is at lunch on a minor deviation from duties in a state that considers such to be course and scope.

      In some states, like Illinois, the analysis tends to sometimes be strained in favor of finding coverage.

      But is also clear that this person probably heard about the “McDonald’s Coffee Claim” from New Mexico that is still legend and lore, and apparently decided to try and do a remake.

      My opinions and experiences, yours may differ.

    This person is a prime example of TSTL. (too stupid to live) Trying to fake an injury & medical treatment has to be one of the worst ideas ever.

    McDonald’s used to have some of the best coffee – everyone knows the hotter water brings out the better flavors — then they got hit with some of the same type stupidity claims back in the 80’s
