Why aren’t they suing the manufacturer? While a vapor/e-cigarette shop might make their own juices, they rarely make the hardware. I suppose they might have a case for negligence (although exploding e-cigarette batteries are hardly a new thing,) but if anything, they should be going after the company that actually made the battery for selling a defective product.
BS, they WILL be going after the manufacturer next. Either that, or the shop will be subrogating against the manufacturer. Just a matter of time. I can’t even tell you how many of these accounts I’ve seen come through. New industry with too little research as to the potential for loss with all of the products involved. The chickens are now coming home to roost.
The shop is just the low hanging fruit. Lawyers will keep shaking the tree until they get everyone. This case is as bad as the Starbucks coffee case recently.
