My guess is that a government employee is hired “at will” and therefore can be legally terminated for any reason – or no reason at all. I anticipate that this will be a steep uphill climb for her.

She was in the job of a public official which in itself involves the trust of the public. Someone who then goes out and commits a 3rd DWI and aggravated at that which in NM is .16 BAC or above, refusal to take BAC test does not deserve the publics trust and should not be in that type of position. It is not like she was in a clerical or support roll after all she was the county manager.

Hey, just give me the county car. I promise not to run over anyone while DUI. So what if I have three on my record and don’t have sense enough to not get behind the wheel while driving.

Isn’t that the reasoning used by people suck as Ray Rice or recently Johnny Manziel? Beating my wife/girlfriend happened outside of my job, so it shouldn’t matter!

Jack, I know of a case many years ago of an elected Sheriff that was a drunk. He had several DUI’s and accidents. He was excluded from the county Auto and had to drive his own car. Needless to say, the publicity did him no good at election time so he was turned away by the folks.
