Generally you sign waivers prior to getting in the raft. I think she’s saying that they weren’t warned how bad the rapids were. I highly doubt this. BUT in todays world you have to try to get money from someone.
Also possible that he signed up for a raft trip w/o rapids, or the rapids were mild (Class I ?), or the operator of the raft was improperly trained, or the waiver isn’t valid, or, or, or…
We ARE a litigious society, and if the plaintiff can find an attorney to take the case, well, they’re off to the court-races. From my experience, most plaintiff lawyers are looking to settle anyway; taking a case to a jury is WAY to risky.
So a guy takes a raft trip on white water with rapids knowing it was dangerous and then the wife thinks she has to sue? What was he on, weed?
