There is (and should NEVER be) no insurance against stupidity. This man chose to entertain the attendees at a baseball game with his gluttonous behavior and died in the process. I did not see that the tacos were poisoned, our under/over cooked, and I did not see the other participants filing like suits.
Insurance DOES cover stupidity. Always has. Stupidity is the driver of most claims.
Commercial truck driver shaving while driving, totals truck and injures another driver. Covered. Painting the living room, forget to move the drop cloth, paint all over carpet. Covered. Not cleaning the commercial vent hood regularly, grease fire burns down the restaurant. (because they also forgot to have the suppression system checked) Covered.
Intentional acts are not covered, stupidity is covered.

Sorry your dad died, but you cannot fix stupid.
I normally don’t agree with Polar, but “nobody told my dad he might choke while eating” is an absurd argument to make.
When your eating tortilla chips fast or taco shells you can choke. He should of made an better decision.
Not having a medical response team is also part of the accusation

with all due respect, that’s exactly the way I wanna go.
All that’s missing is the obligatory “he died doing what he loved…thoughts-n-prayerz…izzut too soon?”
Another meritless, nuisance lawsuit. Guy assumed liability when he entered the stupid contest and probably a release.
