A former Mississippi insurance agent is asking a federal judge for speedy consideration of his motion to vacate his conviction related to an insurance scam involving Lafayette County.
Ken Nowlin of Ecru pleaded guilty in 2007 to conspiracy charges related to his role in a scheme involving Lafayette County’s health care coverage. Nowlin also paid $275,942 in restitution to Lafayette County. He was sentenced in 2008 to 30 months in prison.
After serving his sentence, Nowlin filed a lawsuit in 2010 arguing he was coerced into pleading guilty. U.S. District Court Judge Sharion Aycock dismissed the case.
The Oxford Eagle reported Nowlin and his attorney are asking for an expedited hearing to consider vacating Nowlin’s conviction.
Nowlin argues prosecutors failed to prove a federal conspiracy. He argues the alleged conspiracy must have some connection with the business and transactions of the government entity that received $10,000 in federal program funds.
Nowlin argues the Lafayette County Board of Supervisors received no federal program funds related to their decision-making regarding the county Employees Health Insurance contract.
