I am an Tax Preparer and an Enrolled Agent and subscribe to E&O insurance. As a mortgage broker I subscribe to a $50,000 bond and now I am a licensed RE Broker where the Association of Realtors want me to subscribe to their E&O Insurance. Isn’t there a way to be covered under one umbrella policy?

My 19 yr old son wants to start working as an apprentice for a friend of mine that owns his own real estate inspection service.He will be paid as an independent contractor w/ a 1099 to release the friend’s business liability of paying for insurance, taxes, health, worker’s comp, etc.
Now the friend wants my son to take out a $100K E&O policy and we are finding it to be quite expensive. I realize my friend’s situation and wanting to limit his own liability and risk but is there a better way to accomplish this? It seems my son is the one left out here. He will have to file his own taxes, has no medical coverage, and will have to pay for an insurance policy in case he makes a mistake that my friend doesn’t catch.

We have a subsidiary who is in the domestic transportation brokerage business, but recently decided to expand into Int’l Freight Forwarding. They will just be typing up the Bill of Lading, their name will not be on the documents, just the shippers name and customers name (who contracted our assistance). We need to obtain Freight Forwarder E&O – on the documentation side. I believe the lowest limit is $250K w/$50K deductible, can you confirm? As well, what type of costs should we look to pay. Some carriers want to charge excessive amounts, i.e.; anywhere from $18K – $32K, but it is more insurance than I believe we need for the services we will be providing. I was told Freight Forwarder E&O policies start at $3K+ for documentation only. Can you please shed some light on this type of coverage and advise who the top carriers would be for this industry?

We have a small business and have had E & O coverage for many years and have never had a claim. We understand and appreciate the need for it. The real problem with this type of insurance is if you have a large claim toward the end of the policy year you will never get insurance again (or you will never be able to afford insurance again). If it happens that you have another claim, you may well be out of business. So it most cases you will get one claim only even if you have 20 years of no claims. I wish E & O insurance were sold in policy periods of 3 years, where the policy could not be canceled for 3 years. I would be willing to pay 30% more per year for this type of coverage. Does it exist?

I have been a Title Insurance agent for 6 years and last year had a claim that was settled because my carrier did not want the expense of a trial even though it was documented I was not at fault. As a result my premium went from $6000,to $15,000 to $31,000!!! for my renewal. Is there any hope?????
I need help? I am a Realtor in miami dade county, FL. I had this tenant moving in on a Friday evening. He was suppose to bring me a cashiers check but the course of the moving he forgot. So in good faith I gave him the keys to the apartment as he said he would bring a cashiers check tomorrow morning ( this tenant was a referreal from a realtor I do alot of business with and thats why I trusted him to bring me the cashiers check). Its been 1 month and half and still no money. My broker came to me and told me I personally have to pay for the eviction which is around $1,000.00. My brokerage has E&O which I pay $45 for every file I turn in and now they dont want me to use the Insurance to cover this error. Is this legal for them to make me pay for it even though I pay $45 on every file I turn in for E&O. ( this is the first mistake i have made in 2 years with the company). Can someone tell me if the broker could use his E&O insurance to pay for this or are they just being difficult and making me pay for this out of my pocket?
Great article. I’d be wary of the programs offerred online for “instant E+O coverage.” Like the article says there is no one-size-fits-all policy. You’re better off meeting with an experienced professional that will evaluate your particular situation, and tailor a policy to meet your needs-and your budget.

A US based company is hiring independent contractors for a few hours a week during one year.
These contractors are on call to help debug an electronic medical record system (so these contractors are NOT doing anything directly medical, it’s more how to handle the computer system).
The company is asking the contractors to have an E&O or some kind of liability insurance. One of the contractor is not residing in the US and is not a US citizen (but she has a SSN as she worked many years in the US before). Is it possible to purchase an E&O that will cover her? Keep in mind, price should be kept low as the contractors pay is low (only a few hours/week).

I’m starting a home based business that will provide consulting services to families about living and healthcare options for seniors. I would like to get some quotes for E&O ins coverage.
I work for a company that provides healthcare staffing to the Federal government. Healthcare staffing is a new area for this company, which has historically provided administrative/non-clinical support in many areas, not necessarily in healthcare. There seems to be some confusion in our finance office about E&O insurance for healthcare contracts. Can we get a blanket policy for the company that would cover us on all contracts? Or do we have to have a separate policy for each contract? If the healthcare workers have their own professional liability insurance, are we also required to provide coverage? If so, do we have to insure each person individually, or will our corporate policy cover everyone on the contract? Our accountant seems to be under the impression that we have to have a separate policy for each employee, and wants to add the cost of this insurance to our direct labor rates, but I think this is incorrect and drives up our cost unnecessarily. Our office is located in Maryland, but we work in multiple states.

Hi, I work as a Health and Safety Coordinator/advisor in industrial demolition and/or construction (concrete, steel, piping, cranes,etc). Within this industy, I am required to comprehensively review multiple documents pertaining to a variety of task(multi-disciplined trades), to assess relevant hazards and approve and/or develop controls after the initial development of these documents by site level and upper management as well as practice due diligence (the “aught reasonably to have known” and “Reasonably Practicible” clauses).
My concern is that if a major incident occurs; Is there a potential for liability to be directed at me, even though I do not direct any work? It is my understanding that my position is to observe, report, make recommendations and advise on OH&S Law, Regulations, Industry Standards, Best Practices and Guidelines in order to assist in reflecting this information into the development of our companies Safe Work Procedures and Practices to assure minimum standards are meet and /or exceeded upon.
I would definately appreciate any advise or guidance on this matter and how I can best protect myself from litigation while protecting the health and safety of the workers which is my utmost concern and passion.

I recently became a notary public and in reading their materials, it said that I may want to get E&O insurance. I will really only be notarizing for the employees at my company (about 30 people) and really, never anyone from off the street. It seems a bit overkill to get the E&O insurance for such a lowly task. Am I right? Or is it indeed wise to invest in E&O?
Just like the risk taken daily in driving our cars, it only takes one mistake. And, the fact that you stated you sign only for those in your company and never anyone from off the street is a moot point…It’s not about the signer, it’s about the Notary. Signer’s are protected by your bond — if one is required in your state BUT E&O is coverage for YOU…if YOU get sued for any notarization error OR if it simply perceived that you made a mistake. You’ll still have to go to court if a lawsuit is brought against you…that costs money! Let the insurance handle it! One little car accidents is one BIG headache even with insurance. Imagine an accident without out it. The time it takes, the money it costs…E&O is inexpensive, it covers you up to your policy limit. It’s just a wise idea when dealing with even one person, one document, one notarization.

I am looking at starting my own insurance agency in Florida. I would like to get an estimate for E&O insurance.
I have been a Title Insurance agent for 6 years and last year had a claim that was settled because my carrier did not want the expense of a trial even though it was documented I was not at fault. As a result my premium went from $6000,to $15,000 to $31,000!!! for my renewal. Is there any hope?????

I need help? I am a Realtor in miami dade county, FL. I had this tenant moving in on a Friday evening. He was suppose to bring me a cashiers check but the course of the moving he forgot. So in good faith I gave him the keys to the apartment as he said he would bring a cashiers check tomorrow morning ( this tenant was a referreal from a realtor I do alot of business with and thats why I trusted him to bring me the cashiers check). Its been 1 month and half and still no money. My broker came to me and told me I personally have to pay for the eviction which is around $1,000.00. My brokerage has E&O which I pay $45 for every file I turn in and now they dont want me to use the Insurance to cover this error. Is this legal for them to make me pay for it even though I pay $45 on every file I turn in for E&O. ( this is the first mistake i have made in 2 years with the company). Can someone tell me if the broker could use his E&O insurance to pay for this or are they just being difficult and making me pay for this out of my pocket?

You’re better off meeting with an experienced professional that will evaluate your particular situation, and tailor a policy to meet your needs-and your budget.

A US based company is hiring independent contractors for a few hours a week during one year.
These contractors are on call to help debug an electronic medical record system (so these contractors are NOT doing anything directly medical, it’s more how to handle the computer system).
The company is asking the contractors to have an E&O or some kind of liability insurance. One of the contractor is not residing in the US and is not a US citizen (but she has a SSN as she worked many years in the US before). Is it possible to purchase an E&O that will cover her? Keep in mind, price should be kept low as the contractors pay is low (only a few hours/week).

I work for a company that provides healthcare staffing to the Federal government. Healthcare staffing is a new area for this company, which has historically provided administrative/non-clinical support in many areas, not necessarily in healthcare. There seems to be some confusion in our finance office about E&O insurance for healthcare contracts. Can we get a blanket policy for the company that would cover us on all contracts? Or do we have to have a separate policy for each contract? If the healthcare workers have their own professional liability insurance, are we also required to provide coverage? If so, do we have to insure each person individually, or will our corporate policy cover everyone on the contract? Our accountant seems to be under the impression that we have to have a separate policy for each employee, and wants to add the cost of this insurance to our direct labor rates, but I think this is incorrect and drives up our cost unnecessarily. Our office is located in Maryland, but we work in multiple states.

Hi, I work as a Health and Safety Coordinator/advisor in industrial demolition and/or construction (concrete, steel, piping, cranes,etc). Within this industy, I am required to comprehensively review multiple documents pertaining to a variety of task(multi-disciplined trades), to assess relevant hazards and approve and/or develop controls after the initial development of these documents by site level and upper management as well as practice due diligence (the “aught reasonably to have known” and “Reasonably Practicible” clauses).
My concern is that if a major incident occurs; Is there a potential for liability to be directed at me, even though I do not direct any work? It is my understanding that my position is to observe, report, make recommendations and advise on OH&S Law, Regulations, Industry Standards, Best Practices and Guidelines in order to assist in reflecting this information into the development of our companies Safe Work Procedures and Practices to assure minimum standards are meet and /or exceeded upon.
I would definately appreciate any advise or guidance on this matter and how I can best protect myself from litigation while protecting the health and safety of the workers which is my utmost concern and passion.

I recently became a notary public and in reading their materials, it said that I may want to get E&O insurance. I will really only be notarizing for the employees at my company (about 30 people) and really, never anyone from off the street. It seems a bit overkill to get the E&O insurance for such a lowly task. Am I right? Or is it indeed wise to invest in E&O?
Just like the risk taken daily in driving our cars, it only takes one mistake. And, the fact that you stated you sign only for those in your company and never anyone from off the street is a moot point…It’s not about the signer, it’s about the Notary. Signer’s are protected by your bond — if one is required in your state BUT E&O is coverage for YOU…if YOU get sued for any notarization error OR if it simply perceived that you made a mistake. You’ll still have to go to court if a lawsuit is brought against you…that costs money! Let the insurance handle it! One little car accidents is one BIG headache even with insurance. Imagine an accident without out it. The time it takes, the money it costs…E&O is inexpensive, it covers you up to your policy limit. It’s just a wise idea when dealing with even one person, one document, one notarization.
