Hospitality Program
Nuts & Bolts: Underwriters at PLIS are offering The Hospitality program, written on Lloyd’s paper covering named perils ranging from Aeromonas hydrophila to Yersinia enterocolotica. The policy has the benefit of: a “trade name trigger;” up to 25 percent of the applicable limits available for “incident response expenses” including immediate crisis management expenses (as approved by underwriters), communications, marketing and media support (as approved by underwriters); coverage for accidental and malicious contamination for named perils; and dual coverage trigger of an actual or alleged incident and a media announcement. A seven-day/10 percent reduction of sales waiting period then coverage may be provided back to “day one/dollar one.” Separate sub-limit coverage for suppliers and extortion can be considered. The hospitality program also has access to the certified crisis management team of Specialty Risk Management Inc. SRM has expertise on food law, public health law, communicable diseases/ pathology, media and marketing techniques, and food borne illness protocols. The SRM Crisis Management Team is available 24/7 and is able to work directly or indirectly with local, state or federal health authorities.

Non Medical Miscellaneous E&O

Parking and Valet Operators Program
Nuts & Bolts: USRisk Brokers, a subsidiary of U.S. Risk Insurance Group, has introduced a Parking and Valet Operators Program for businesses engaged in operations related to parking customers’ cars, such as self-parking garages and lots, assisted parking, valet parking and parking for special events. Exposures can include parking operations at retail or office complexes, hotels, entertainment venues, restaurants, medical centers, high-rise residential facilities and airports, and extend to incidental operations in conjunction with parking, such as car washing, detailing and minor repairs; moving a customer’s vehicle to a repair facility for minor repairs; and basic concierge-type services such as luggage assistance or bellman operations. The program provides commercial general liability with broadened coverages, and garagekeepers legal liability.

Small Business EPL Package
Nuts & Bolts: CNA has enhanced its management and professional liability package policy to create Epack EZ. Targeting companies with less than 50 employees and $10 million in assets, Epack EZ offers a stand alone employment practice liability (EPL) policy or combination EPL, directors and officers, and fiduciary policy. Epack EZ offers online applications to obtain quotes. Eligible policyholders also have access to a Web site devoted to managing employment exposures. Epack EZ offers a two-year policy term and a separate limit for defense cost. Other standard policy enhancements include: a broad insured definition that includes domestic partners; a broad definition of covered wrongful employment practices; automatic coverage for third-party claims; punitive damages coverages; and independent contractor coverage.

D&O Coverage for Small Public Companies
Nuts & Bolts: The Chubb Group of Insurance Companies has introduced specialized directors and officers liability insurance for publicly traded companies with market capitalizations of $100 million or less. The “micro-cap” coverage enhancements can be added to Chubb’s D&O liability insurance policy. Some small public company customers may be eligible to receive a non-rescindable endorsement.

Micro-cap D&O coverage highlights include: independent directorship liability, which may help a company attract, retain and protect outside directors by offering up to an additional $1 million of coverage outside the directors and officers liability insurance policy limit for independent directors; amended exclusionary conduct wording that requires final adjudication to establish fraud and illegal personal profit; a definition of “claim” enabling the policy to be triggered if an insured person is investigated by the Securities and Exchange Commission, U.S. Department of Justice or similar regulatory or law enforcement authority; a new non-rescindable endorsement, designed to preserve coverage for directors and officers by providing severability for all D&O policy insuring clauses.
