New York Superintendent Gregory Serio announced that Samuel Gardner, 41, of Kent, New York, was arrested and charged with Insurance Fraud, Arson and Attempted Grand Larceny.
On July 28, 2002 Mr. Gardner’s home was destroyed by fire. Gardner had been present at his home with his two sons just prior to the fire. The investigation reportedly revealed that at least 10 separate fires had been set inside the house. Prior to leaving the area on July 28, 2002, Gardner reportedly placed his children into his vehicle along with their personal belongings and he re-entered the house to retrieve his cell phone. A list of contents presented to the United Frontier Mutual Insurance Company contained the children’s personal belongings. The insurance claim was for a total of $120,000 and has been denied by United Frontier Mutual.
On July 2, 2003, Gardner was arrested and the case will be presented to a Grand Jury in August.
If convicted of these charges he faces up to 15 years in state prison.
