N. Dak. Man Sentenced for Workers Comp Violations

The Northeast Judicial Court of Devils Lake, North Dakota sentenced Myron Wittwer to serve 30 days in the Bottineau County Jail with 30 days suspended for a period of 1 year, and placed him on unsupervised probation for a period of one year, on condition that he pay North Dakota Workers Compensation $4000 in restitution by April 2003, for failing to secure workers compensation coverage and filing false workers compensation claims.

He was also ordered to pay an $80 fine and $20 to the victim/witness crime fund. Judge Lester Ketterling sentenced Wittwer on two Class A misdemeanor counts, after the original charges of class C felonies were reduced.

Wittmer’s violations were discovered as a result of a routine check by a NDWC Claims Analyst that led to an investigation by NDWC’s Special Investigations Unit, which ultimately determined that while Wittwer was receiving NDWC benefits, he failed to report earnings from a business venture and failed to provide NDWC coverage for his employees.

The failure to report his employment and income in excess of $500 constituted a violation of the law.
