definately hard to citate because you can’t confiscate the phone. the only thing they could possibly do is find a cellphone number, but then again that is privacy and can’t be gotten without a warrant and that can be costly just to define a reason for a judge to get that and then ask for phone records. you hope that it states recieving a text message or sending one. next thing, you will want them to find you while you are parked or at a stop light texting. but how many cops do you see using the phone or even a laptop? wud you consider a laptop just like a cellphone? using it while driving can cause a distraction….. so do we have a right to give you the cop a ticket? i know we want folks to be more responsible, but sounds like a failure in our gov’t to think we can over-regulate everything and get nothing for it. how many cops speed and don’t get tickets? as a cop, you need to identify if they are texting or dialing? i know some kids can text w/o looking at the keys – ask my daughter. it’s bad enough she can’t even sit at dinner w/o that cellphone, even w/my evil eye looking at because of it…

Why not indeed. I hope you were not offended by my remark-I frequently create new words myself.
