I too have had several dealings with this MGA. They were great at first and I placed several accounts with them. Now, they ACH funds from current and cancelled accounts with no reason. One client had a policy with a premium of a little over $3,000. NUM pulled over $9,000 from the account. This was done in small,random amounts over a period of time. I for one am very glad to see this article as well as the DOI doing their job. Crooks like this ruin our industry!
After being informed by Mr. Fendlers attorney that “all available remedies” will be used against me because of my post I hereby withdraw it. However, the proof in the long run will be the finding of the Illinois Dept of Insurance, and the conclusion of the Missouri Dept of Insurance.
Effectively? I believe that an attorney would call it slander and libel. However, odds are that if it went to suit, one could point to the preponderance of facts and defend successfully. Unfortunately that still costs money.
I concur Caffiend. However, in order for this statement to be considered libel or slander, it would have to be false. It appears to me that he was merely stating facts regarding his personal situation (which mirror countless other complaints) and his opinion of Fendler. He has every right to express his own opinion and is clearly protected by the constitution. But, to your point, he would still have to defend himself if Fendler’s attorney were to file suit. One would think Fendler has enough lawsuits on his plate, but then again, nothing would surprise me with this guy.

Yet, his attorney says they are “pending and we’re hoping for good outcomes on those matters. … We’re certain we’ll resolve them.”

In my opinion, prison had better be the end of this story.
The end story here had better include a sentence to prison… if/when convicted.
