Another waste of time for our judicial system. Hurricane data is available to everyone on the internet. You can look at the reports and decide for yourself to get on or not get on the ship. And, if you are willing to get on a boat that is going out into the ocean, then you must be willing to take on the risk that comes with that. Nobody forced any of the passengers to get on the ship. People need to stop blaming others for their own decisions.
Obviously there is inherent risk in taking a cruise (and most passengers are aware of this). Nonetheless, the carrier has the responsibility to do it’s utmost to ensure the safety of it’s passengers. The cruise line must perform its due diligence, especially weather/ocean condition related. If there were any doubt – if there were warnings in the area and the captain chose to sail anyway, someone must be held liable for that – other than the passengers. If you were on an airplane that had weather warnings and it was decided that the plane would fly into a hurricane anyway – would you still feel that it’s the passengers’ problem because they got on the plane?
I would be sueing as well if i encountered going through something like this if i were on that ship…first of all they made a wrong decision letting the sail sail out of bayonne, new jersey that day… I have been on my many cruises out of the northeast , and when the atlantic is angry, and there are storms brewing down in the Cape Hatteras area in North Carolina it is no joke…. I once went through an eye of a hurricane, just like what the people on Anthem encountered, and it is no joke….being confined to your rooms…holding on to dear life, wondering what is going on outside beyond the cabin doors….wine bottles be tossed around…dishes breaking….it is a horrific experience….yes the line refunded the money to everyone, and gave them 50% off another cruise…. but what about the emotional and terrifying experience that they went through….think about that….these people have a right to sue the line…..and right now there are 2 people….but i guarantee you there will be many, many lawsuits against this line…as it was forewarned about the storm…in the Hatteras area…and that is no area to fool around in…that is the roughest waters right there….Now the ship is on another Journey and is forced to turn around because of another storm brewing…plus the passengers have norovirus…. what RCCL should have done was have letters printed about this storm brewing….give the passengers the choice if they wanted to sail or not…if they didn’t want to sail then offer them compensation and 50% off a cruise…as least you were forewarning the people…not let them get on the ship and have the captain announce that they will be hitting rough waters…and that he was going to try and go around the storm….
I went through storms worse than this when I was in the Navy. I served on an Aircraft Carrier, and we encounter storms that were a lot worse. This is the risk you take when going to sea on a ship. Cathy storms at sea are very unpredictable. The storms are changing all the time. I have been through a Hurricane while at sea. That is what we risk when ships sail the worlds oceans.
FFA, it is a bit safer to cruise out of Miami than Bayonne, NJ. No captain should ever try to cruise through a major storm, no matter how big the ship is. My recent cruise was the Hawaii Islands and the ocean was calm the whole time and it was terrific.
I would agree with you on that point. There is enough technology out there to know your heading straight into the storm that should give you time to take evasive action. I’ve only sailed out of Miami and have never had a problem. It is my understanding that these ship lines give the captain the authority to make any decision necessary for safety sake.
Unless this storm just whipped up out of no where, RCCL should have done a lot better for the passengers then to just refund and offer half off if they take another cruise. Half off was just a weak attempt to save face.
As a passenger you give the cruise line thousands of dollars for a cruise (usually 75 days or more ahead of the sailing). Guess what you get if you cancel or don’t take the cruise? $0. We as passengers are assured that our safety is the cruise line’s top priority, therefore if a cruise line doesn’t cancel we aren’t left with much of a choice except to forfeit 100% of our cruise fare.
louie, I encourage you to try it sometime and sail out of Miami, not Bayonne. Most cruise lines have very excellent food from a variety of restaurants on board, entertainment with very good shows, stop at very good ports of call, you can take side excursions at the ports. Some have casinos if you want to gamble a bit. I wasn’t too sure I would like a cruise until I did it. I have a partner who does a cruise every year. He and his wife have loved every one. I will be taking another one this year as well.

People who book a cruise accept certain risks, however, having the Captain knowingly sail into hurricane force winds when it could have been avoided, is not one of those risks you accept.
The more likely scenario is that delaying the cruise or keeping to the schedule no matter what was for the economics of the cruise line.

That’s for sure, CL. People sue for anything and everything these days. Don’t know this for sure, but I’m betting more so in the Northeast.

If the Cruise line prevails, they should be entitled to every penny they pay out defending this.

I have been on multiple cruises and always pay for the trip insurance where I can cancel for any reason and get a refund.
I’ve personally never taken a cruise…Can’t really understand the point of going on a boat if you can’t fish from it.
