Tulsa County DA to Get Case of Former Insurance Commissioner

A district judge in Oklahoma has turned over handling of the tax-evasion case of former Insurance Commissioner Carroll Fisher to the Tulsa County District Attorney’s Office.

Since the venue where Fisher has been charged is Tulsa County, it will be up to the district attorney’s office to go forward alone, or ask the governor to appoint someone from the attorney general’s office to assist in the case, Associate District Judge Dana Kuehn ruled.

The office also could choose not to proceed with the case, which would be unlikely.

A spokeswoman in the district attorney’s office could not immediately comment on the ruling.

Fisher is still scheduled to stand trial Aug. 18 on charges he filed a false state tax return for 1999 by underreporting his income by $4,688.

The charge was first filed in Oklahoma County but moved to Tulsa because Fisher signed the tax return in Tulsa.

Fisher previously waived his right to a preliminary hearing.

He is currently serving a three-year prison term for embezzling $1,000 from his campaign and lying on a contributions report.

He also faces trial in Oklahoma City on bribery charges.

Fisher was insurance commissioner for almost six years, first elected in 1998 and re-elected in 2002.

He was impeached by the House in 2004 and resigned before a Senate trial.
