Yeah, sounds like the company threw her under the, uh, Coke Truck on this.
The plantiff did indeed suffer serious injuries. That said, $24 million is completely out of line. No mention of paralysis, just back and neck pain and lumbar surgery. Coke should appeal, this is not a justifiable award based on what is offered in this article. Maybe there is far more to the story than what is here?
interesting that i was fine w/the article and was going to state they should appeal for the amount… but then to read the rest of the story – “testified she was not aware of the risks involved in using a cellphone while driving,” your a professional driver when you drive a truck. you have to know!! this was a big mistake and will cost that company lots of money!
The attorney’s will negotiate this settlement down to a more reasonable number. The driver should never have been behind the wheel of a heavy truck if she didn’t know it was dangerous to drive while on a cell phone. For all we know, she may have been trying to text while driving. It is the most dangerous activity one can do is talk on a cell while driving. Cell phone addicts are causing much of the accidents on our roads today. I have seen them actually walk out into a driveway and they never had a clue I was sitting there in my car waiting for them to get out of the way. I had to honk to get them to move.
Wonder what the award would have been if it was Average Joe in his ten year old (or older) vehicle?
The attorney saw deep pockets and went for it. Had it been just a redneck contractor, they would have gotten policy limits and that would have been the end of it.
To many accidents are happening because of cell phone use. It’s hard for me to understand a driver claim they didn’t know how dangerous it is to drive a commercial vehicle and talk on a cell phone. A commercial driver need to be totally aware of what is going on around him. A cell phone is distracting and there is enough distraction, and cell phones just add to the problem.
