In areas where there is a prospect for oil in Tx the mineral rights are retained and there is a waiver of surface rights granted. The folks making mortgages in Tx understand this. So if someone in Fl has a problem they should call a Tx bank for help. (I suspect an Ok bank would also understand). The question occurs however who pays if production results in a sink hole?
