Instead of going after the theater chain (i.e. deeper pockets), why not go after the psychologist/psychiatrist who was “treating” the guy?
While I truly do sympathize with theis family, this is a tragedy that couldn’t have been foreseen. As an increasingly violent society and the politically correct climate we find ourselves in, how can we ever have enough protection and at what cost ? I’m trying to put myself in the victim’s shoes and I just can’t see myself suing the theater. Do you have security guards at every door of every business in America ? What kind of weaponary and how much do you arm them with ? Then there’s an issue of a private citizen being a security guard and shooting someone .. they are not police officers and lawsuits could be brought against them. I honestly think that I would spend the time trying to lobby for new laws and stricter punishments than to sue the theater, who really was not negligent in my opinion.
This is a tragic incident, but how can you blame the theater operator for this? You cannot place heavily armed Security guards to guard every entrance to a public place. The individual had booby trapped his apratment, and now is claiming mental incapasity. He planned in detail what he was trying to do. Everyone need to remember that weapons do not kill, but the individuals kill. A weapon cannot discharge on it’s own. People want to ban weapons, but auto accident kill more people each year that weapons. Why don’t we ban autos for killing someone. We should hold the individual responciple for the criminal act , and quit trying to may them a victim.
This is stupid. I wonder how much he is suing for. I can’t imagine losing a child but at this point would $ make it any easier? I think I would rather move on than relive the brutal attacks. Either way, better start saving up for the increased cost of going to the movies.
As an objective observer to this commentary (as well as the tragic incident itself), I also agree that there was no way the attack could’ve been forseen; at most, additional security-if available-would’ve concentrated on keeping any rowdiness down on the lines outside the theater. Something good that might come out of all this is perhaps a security monitoring system akin to the dome light in your car: once the scheduled movie begins, each auditorium’s (re: multiplex) screen-oriented exit doors would have an alarm light or signal that alerts in the theater’s security office when any of those doors are opened during the movie. This is how the shooter was able to pull off his cowardly, horrendous attack by parking his car near the auditorium door in the rear of the building, entering the movie like all the other patrons, then exiting thru and propping open the door shortly after the film started; since it was midnite, there was no tell-tale light coming from outside to raise any concerns.
Knowledge-So let’s take your thoughts a little further, in this country every year there are far to many people killed in auto accidents, does that indicate that if a car dealer sells a vehicle to someone the dealer is responsible for the accident that happens? Of course not and the seller of the weapon in question which for your information was not a automatic weapon but rather a semi-automatic weapon should not be liable provided they followed the law either.
The problem is one of our society, things like this did not happen 40 years ago. We now live in a very different world, one in which violence is somehow glorified in the media, morals are not taught in many homes and none of the schools, religion is looked down upon and goodness forbid that anyone call a child to task for his or her behavior. It is to simplistic to think that the solution is to just go back to where we came from but it would certainly be nice!
As to gun control they are far more controlled today than 40 years ago but yet things are worse, so I doubt that is the answer, as they say and has been proven in countries/cities like Chicago that have tried it, when guns are outlawed only outlaws will have guns.
So knowledge before you comment next time maybe it would be best if you first gained a little knowledge of the facts.
The primary semi auto weapon that the shooter used was a AR 15 style weapon which has become a very popular weapon for both hunting and home defense. The only thing about the weapon that I feel we as a society should possibly consider limiting is the size of the magazines that he was using. Fortunately for the survivors of this tragedy the shooter was very limited in his knowledge of firearms as the large drum magazine he was using has a tendancy to have feed problems. If he knew what he was doing would have went with the smaller standard magazines and worked on fast reloads of the weapon.
6??? What’s a 6 year-old doing at a midnight showing of “The Dark Knight Rises”??? I absolutely loved the movie but it’s dark, scary, violent, and definitely NOT for a 6 year-old. That said, I can’t imagine the pain and grief they must be going through.

I would think that the firm which sold the killer the weapons would have the most liability in this case.
An automatic weapon poses much more risk tha a hunting rifle or knife and perhaps has less utility in traditional hobbies.

No, he bought a ticket like everyone else; he went out thru the auditorium’s exit to the rear of the theater where he’d already parked his car…
