bob, it is not about intentions, but duty of care. If the surgeon operated and used less care than was legally rquired of him and harm rsulted, then he is negligent and liable for the damages.

PS -We can argue about what level of care is owed. which is the better discussion. However, I am not a doctor and I would leave to the them to decide.
