Colorado Senate Passes Condo Builder Liability Measure

A bill to make it harder to sue condominium builders has cleared its first hurdle in the Colorado Legislature.

The measure would make it harder to sue builders of single and multifamily homes for defective construction. It would require that a homeowners’ association use a mediator before suing, and require them to get written consent from members before suing as a group. Supporters say it would boost construction of more affordable condos.

The bill was approved 6-2 in a Senate committee.

The bill has bipartisan sponsors and is expected to succeed in the Republican Senate.

But prospects are dimmer in the Democratic House, where leaders generally oppose the measure. Opponents say it is too favorable to builders and developers.
