Illinois Latest to Toughen Penalties Against Uninsured Motorists

    My daughter was involved in a hit and run in Chicago with an illegal alien, who was followed and arrested in Indiana, where he apparently lives. He was also issued a DUI at the tie of his arest for hit and run. The Chicago police did not complete the reporting necessary to determine whether the car the alien was driving was insured. We are searching in Indiana to try to get an accdent report. To top it off, my daughter’s substandard insurer says that her license was revoked 4 years and 10 months ago (they have a 5 year underwriting clause) and they have rescinded her insurance. They dis so although she has been insured with the agency for 4 years. The Illinois Insurance Bureau so far has said that since this was a “1st term” policy (daughter’s agency switched the name of the insurer for her new policy)the company had done nothing wrong. Even though the “agency” (separate from the insurer) sent her an application completely filled in (suggesting that if anything were wrong she could change it) and asked her to sign it.

    I know there is seldom justice, particularly in the insurance and illegal alien game. However, isn’t there something we can do? Recover from the uninsured motorist fund? Force insurance arbitration??

    Help!!!

    I am looking for some statistics about uninsured motorists and accidents in IL. Our 33 yr. old son was killed 12/29/05 by a woman who was uninsured. She was hurt badly. So far her fine has been $500. This is an appauling amount for a life.We do not have the option of suing, because she had no health insurance and has immense med. bills. So where is the restitution for the damages going to come from? I would like stiffer penalties for uninsured accidents. If you know a site where I can get the statistics, please let me know via e-mail. Thanks Jennie Orin

    My ex-husband purchased a used vehicle for our 17 yr old son. It was liscensed and titled in My ex husband’s name. He assured us that he purchased liability insurance on the vehicle. We live in Illinois. My son was involved in an accident approx 3 weeks later that injured his passenger. We were deceived as we then found out that the vehicle was uninsured. My son was ticketed for no insurance. Who will be held responsible for restitution to the injured passenger?

    Jennie, Short of suing her personal, not much can be done. Since she had no car insurance, I will assume she has no assets and you will probably be wasting your time. Sorry for your loss.
