I remember my Dad going into surgery. We would mark in big bold letters “Not this one” or “The other side” to make sure the doctor knew which side was to be operated on. That was, in fact part of pre-op. The hospital provided the marker and gave us plenty of time to get him all colored in.
It sounds like this guy has a solid case. Odd for a story in IJ.

I don’t understand how they can make that mistake? Did he have hammer toes on both feet? If not, did the doctor think it had magically disappeared by operation time?
the guy filed for an administrative remedy which was denied, prior to filing suit. Sounds like he tried to get this resolved without going to court, but the government is not quick to admit its failures….

The article I read regarding this story had some other informaiton on this case. I heard that the doctor actually amputated the wrong foot and after discovering his mistake had to amputate the “correct” foot.
When explaining this to the patient he said “I have some good news and some bad news” The bad news is that, unfortunately, I amputated the wrong foot, and after realizing my mistake, I had to amputate your other foot—the good news is the guy in the next room wants to buy your slippers”.

Thanks for the laugh! I just saw the third article over the news wire. Unfortunately, the patient developed infections in both legs that required amputation of both just below the hip joint.
The judge granted defendants motion for summary judgement citing that the plaintiff, legally, did not have a leg to stand on. I hate when that happens!
well, we seem to appear to have a foot pending situation. it appears that one fella asked for help w/his one foot instead is getting help w/both feet. now, as far as good news and bad news — LOL — why not say that he saved a bunch of money on his car insurance! but back to the issue…truly, the podiatrist does have a leg to stand on but will be a bit less nimble w/no feet or foot! i thought that prior to the surgery, does not the surgeon go over the situation prior to the actual surgery that day? i know they did when my wife had problems w/her foot. i like the idea of an earlier posts, where they amply put words on the wrong foot! i hope that the VA will at least pay for both operations since they still have to fix the other foot. and for those who keep blaming BUSH, relax, i never knew that he was the podiatrist surgeon! for that matter, let’s blame capitol hill and all those rich senators and house of representatives. blaming them is like blaming them for the issue of walter reed hospital. when in reality, blame starts at the root of the problem – the surgeon!
