Lori you sound like an intelligent gal but misguided. Don’t blame Rufus or the illegals for all the problems we have in this country. It is true that there have been illegals that have committed crimes and are no good, but most of these people are hard working people that only want a job. I have met many of them are they are nice folks. Just like there are bad illegals there are bad white, black and of every race group known. Let’s not cast generalizations that don’t make sense and are incorrect.

The reason most of these individuals come to our country to work is because waiting for visas takes an enourmous amount of time like 10-20 years or more. The current system promotes them breaking the law because it offers no real options. This is why I support the president’s guest worker plan. Many business need these workers because no one else wants to do those hard labor intensive jobs. Just go an talk to farmers and ask them about this. You will be surprised.

This is sickening! What about the victims of crimes perpetrated by ILLEGALS who are abandoned and ignored by our government and judicial system and left to bear the cost of the injuries they have for LIFE? When is someone, somewhere going to take a stand for them? When do they get a settlement for their pain suffering and the physical health they have lost forever when the government did not enforce its own immigration laws and has the duty to protect us because the US CONSTITUTION SAYS THEY DARN WELL HAVE TO?

Where is this class action law suit?????

I’m sorry, but this is just insane and this madness has got to stop!

And YES WHY DID HE NOT HAVE TO PAY BACK WC FOR ANYTHING? THAT IS A LAW SO WHY NO FOLLOW UP FROM THE LAW? Because he’s illegal that’s why!

And now the United States bends over and lets him back into the country to collect his money. We have a problem here folks.

I won’t lie, I can somewhat understand your frustation Dread….I just wish you had been more carefull with the terminology you chose to use.

But, I think the REAL problem isn’t people wanting to come here for a better life….stopping them is putting a bandaid on something that needs 20 stitches. the problem is these companies that hire illegal immigrants so that they can get cheap labor and not have to pay Work Comp Premiums on the employee.

I agree that the injured person should have to pay back any state agency that issued him free health care, but to be honest, i’m glad that the employer is being punished. as he should be.

if companies do not stop hiring illegal immigrants, there is no reason for people to sneak in here illegally.

The gentlemans’ immigration status had nothing to do with the injury he suffered. He sought benefits due an employee. Period. Nothing more…nothing less. If the employer had WC insurance he would have been insulated from the lawsuit. He chose not to carry WC insurance in a high-risk business. This decision left him at risk. The fact he hired an illegal immigrant means nothing in this case. The only reason it is of interest is the fact he was granted a visa. I am appalled by the commentary here.

And I am equally appalled at your left-wing stance. You don’t illegally enter this country and automatically qualify for the benefits that are available to its citizens. “illegal” is the operative word. Society was formed on the theory that people will abide by the laws and in return receive the benefits and rights of that society. This illegal has no such standing. The fact that you think he’s “entitled” to compensation is frightening. He ran the risk. Should the employer skate? No. But you don’t embellish illegals with the rights and benefits Americans fought and work for. Do you think this guy would have had any benefits back in Mexico? Get real.

Rufus, i don’t necessarily like Dread’s language either, but quite honestly, you would be a fool not to realize that there is a vast majority of americans who feel the way he does. and it’s an emotional issue. illegal immigrants (wherever they may be from) are offered better benefits than most citizens. the citizens work hard and the illegals that CHOSE to abuse the system reap the benefit of our hard earned tax dollars, and that is FRUSTRATING. and then those same illegals parade our streets waving THIER COUNTRY’S flag in our faces saying they won’t be treated unfairly and you want people to be diplomatic and offer you a solution??? well guess what Rufus, there is a solution, there is a system in place that if people followed could be on a path to becoming a citizen or a permanent resident whatever they choose….but instead they sneak in and lie and steal identities and get free food, education, insurance, etc…

this isn’t about race, Rufus, this is about people abiding by laws that are set in place. and i’m not going to feel sorry for any single illegal immigrant who breaks those laws. especially when it costs me my hard, legally earned, money.

It seems odd to me that a few years back there was an oil spill off the coast of Alaska and a giant oil company hauled illegal aliens into Alaska and put them in tents with C-rations from World War I. If they worked hard they were paid every six weeks. If their work was less than agreeable (they failed to work 16 hours per day 6 days per week) then the INS was called and they were deported. Businesses in the US have a demand for labor that illegal aliens meet. If you want to punish the businesses for that conduct I would welcome that effort. But don’t hold your breath on that one. That information made it all the way to the previous Bush administration and nothing was done to the oil company.

Racist Bigots??!! That is so typical. The race card is only played by pro illegal alien advocates to divert attention away from the real issue and that is the millions of illegals in our country who receive benefits they aren’t entitled to, ruin legal US citizens lives and never have to pay the consequences or any recourse; rather the victim and/or their families must suffer the damages and costs.

You say go to Mexico and confront them face to face? How laughable is that? Just walk down the street and chances are you’ll have that opportunity because they are in our own backyard.

The fact that you also immediately turned to a violent stance shows just how ignorant you are. I find it interesting that every time we see these clips on the news and such about rallies and protests that the ones carrying the racist signs, screaming racial epithets and slurs, and who instigate and perpetuate violence are the Illegal Aliens and their Pro-Illegal Advocates.

That is the truth and you all prove it over and over again.

In this case the employer should be fined big time, the illegal shouldn’t get one dime and should have only gotten a one way ticket back across the border. He is Illegal. He is not eligible for benefits that US Citizens are just as we wouldn’t be entitled to any benefits (if they even exist) in Mexico if we were there illegally and working illegally. In fact, we’d be IN JAIL right now if this situation were reversed. Ironically, in Mexico they follow their own laws.

    Imagine that concept!

This isn’t about Mexicans but since you brought it up,name one other race that sneaks into this country en masse to take advantage of things that they aren’t entitled to? Mexicans. If it was someone from Poland I’d refer to him as a Pollack; from Italy a Wop. From Hungary a Hunky. That isn’t racist my boy. Deal with it and stop being so ethno-sensitive. This guy had no status here. To allow him back in to collect just to prove a point to a potentially unscrupulous businessman isn’t right. Thanks to those who commented to Rufus. What part of Illegal do people not understand?

Farmers don’t have to hire illegals – they can hire Mexicans who come here legally as migrant workers. I grew up on a farm that hired migrant workers and we worked beside them in the fields. I have nothing against the ones who do this legally. It is the illegal immigrants of whatever race–they might be from Cuba, India, etc, etc., they have reasons to come here and are hopeful for a better life for their children, but they do not deserve the same rights as American citizens. And it is not fair to us or them for these companies to hire them for lower wages.

society has a protocol that people are required to follow if they wish to become members of that society. In this case, it involves someone in this country illegally. As distateful as it may sound, their failure to have status in our society should prevent them from economic protections. They chose to take a risk by being here illegally. You have to earn rights and protections in any society and this person didn’t. He shouldn’t be abused, but neither should he have the same status, rights, and privileges that legal citizens have. He would have been no worse off had he statyed in his own pathetic country and was injured on the job. Do you think an employer there would have had WC coverage? This illegal certainly knew enough to find an attorney and go after “compensation”. America is becoming the bleeding heart chump for anyone who “wants” everything it offers, but is either too stupid or too lazy to earn it the right way.

There appear to be two separate and distinct issues here (at least).

One – the employer should have provided a safe work environment and should have been carrying workers compensation. He should be dinged for not provided protections to his workers that are mandated by law. He should also be dinged for hiring illegals.

Two – the worker was illegal and as such is truly not entitled to the protections our citizens enjoy. It should take an illegal commiting another crime to get them deported, the crime of entering the country illegally should be enough.

I don’t support a guest worker program because in artificially depresses the wages in that industry, keeping prices artificially low and serves as a canker on business because that sector of society is allowed to routinely break the law. What kind of example does this set?

I do believe the constitution should be amended to read that not only must you be born on American soil to be a citizen but that at least one of your parents must also be a citizen. We nationalized the slaves years ago, time to bring the document up to speed for modern concerns.

I am all for fast deportations. Get them out of here. And fine the heck out of the companies that hire illegals.

And I don’t care if the process is painfully long for people to come in legally. Tough it out – millions do (we allow around 2 million immigrants a year legally). If you can’t do it right, don’t do it at all.

Oh, and I’m not a Republican or a conservative of any stripe. They’re the ones supporting the stupid “guest worker” programs; they’re the ones running the companies that hire illegals. It’s not just Democrats that are soft on illegal immigration, it’s all politicians.

No, Melanie, Bill Clinton is not why we are in this mess. We are in this mess because decades upon decades of administrations, Republican and Democrat, have failed to address the problem. Do you not recall that the last amnesty given to illegals was granted by the Great Republican Ronal Reagan? Clinton granted no amnesty. Clinton forwarded no guest worker policy. Clinton, like Bush before him, simply had no policy when it came to illegals.

Stop trying to pin this on a party people and realize there is no significant differnce between the two major parties. Republicans say that Democrats are “tax and spend” but the only budget surplus in recent history was under a Democrat. Republicans don’t spend less – in fact Bush has spent much more than anybody in recent memory – they just borrow to do it and leave it to a Democratic administration to actually pay the damn bills. Neither one truly wants small government. It was a Republican (Bush again) that was the first to add on a cabinet post in over 50 years. And tell me that the majority of America enjoys a lower tax burden now than 10 years ago – we don’t. And we won’t under Obama, Romney, Clinton, Huckabee or anyone else currently running – they don’t have the clout or the stones to change it.

Nor do they have the clout or the stones to truly stick with immigration policy. None of them. The Democrats will cite human interests and the Republicans will cite business interests. What they really mean is they don’t have the stones to make some people not like them.

The fact is, an employee was injured on the job, therefore the injured worker, whether legal or illegal, is subject to workers compensation benefits for the injury. If an employer neglected an employee’s legal status, then the employer is responsible for all ramifications — not the employee. If an employer neglected to have workers comp, then the employer is responsible for all ramifications — not the employee. As an employer, you are responsible for the safety and well being of every single employee regardless of legal status. Not only is this the law, but a basic human right.

This is not an immigration issue. This is a labor issue!

Melanie, it’s not true that having a U.S.-born child automatically entitles their parents to remain in the country – in fact, quite the opposite: there have been many instances where the parents were deported regardless of the fact that their child was a U.S. citizen. What is true, however, is that the child cannot be deported under any circumstances: regardless of their parents’ status, any child born in the U.S. is a U.S. citizen, with all the rights and privileges pertaining thereto; and that means that they are entitled to remain in the country. One would hope that parents would take their minor children with them, but the reality is that they cannot be forced to – if they decide to leave the child in the U.S., either a relative or the state becomes the legal guardian (in the latter case, that would most likely involve placement in a foster home).

Yes, the issue is not race related. That is obvious. Unfortunately, there are several posting that have twisted the facts into a race related issue. That is the point. READ MY POSTING AGAIN – SLOWLY SO YOU CAN UNDERSTAND.

Again, this is not about immigration it’s a labor issue. As simple as that!

And who’s stealing? The employer hired an employee, the employee was hurt on the job, and therefore employee is entitled to workers comp benefits. An employee’s legal status does not play apart.

I will tell you who got screwed on this deal – the hospital and doctors. I guarantee you that they did not get paid . . . The hospital may have received something from the Feds for treating an illegal immigrant, but the surgeon – nothing . . . Illegal immigrants are cheaters and those who hire them are crooks and the American taxpayer gets screwed.

Good grief! This country is really nuts! Where does the responsibility for one’s self stop? At the border? If this guy was getting paid while he was laid up, and his medical bills were paid, what does he have a gripe about? Illegal? If he wasn’t here it wouldn’t have happened. I think the employer, the land lord and the judge should all be fined, and even face some jail time, for facilitating an illegal! Yes, the judge too!

This happens in the U.S. every day, many times each day. When will these employers understand that it does not benefit them to hire illegals, who are frequently injured thru carelessness and inability to read or follow instructions. Then they run up massive medical bills and sue the employer. The taxpayer pays their medical bills and the the award outweighs the money the employer saved not paying benefits and taxes.

This one is just so hard to leave alone. I’ve seen my home town and surrounding areas economic structure almost collapse under the weight of illegals. Employers are cashing in on illegals while the state is burdened to finance their immoral decisions. I know people that have had to sell their homes and move away from their friends and family in order to make a decent living. And the schools that educate our children suffer the burden as well or actually OUR CHILDRENS education suffers. It is and has alway’s been against the law to fail to report a crime that you have knowledge of but besides failing your country not reporting illegals fails your childrens future.

We had to take our son out of school because he (and other American kids) were being held back because the teacher spent so much time with the kids who didn’t speak, read, write or understand English. My other son is leaving this state because he cannot afford to rent, buy a home or make a decent wage to pay the exhorbitant cost of living here. This is a despicable situation that American citizens cannot survive and are penalized so employers and those in power can continue to abuse us, while ignoring the illegals and their criminal ways. There must be someone out there who is honest and take the wheel of this sinking American ship. Come forward, we beg you!

i dont know where you studied history sheltowee but give it a break. Your speaking out of church and some real mixed up facts. remember focus, focus, focus….My family for as far back and beyond record keeping is from here and although we never ate human hearts we did cut the heads off of trespassers and mount them on a pole facing the direction they were found coming from but it was only to warn they’re freinds that encroaching on us was a punishible offense. Even today we dont see anything wrong with lifting hair after a good *** whipping..i mean it wont kill ya.. you just have to live with a little billboard on your head that say’s you shoulda minded your own business. And as far as Oklahoma goes ..if your illegal well that word in itself say’s it all ..Cowboy up …or Cowl down

Employer’s can’t have their cake and eat it too? Maybe they shouldn’t be hiring illegal help? Duh? And if they didn’t maybe their children wouldn’t be here going to school. By the way the Mexican’s are American Indians that were forced out of their country. They have a right to come back. You know, it happenened like this. . we kicked there asses first, then gave them a peace pipe and said we will kick it no more if you sign this treaty giving us all the good land and you take to the desert. Remember the Cherokee Nation? It happened to them too as to many other tribes. Granted some of the tribes were barbaric and actually cut out the heart of men and ate it but this was condoned by the French. Remember or do you know any of your history or where you came from. When did you get here? My ancestor’s can be traced back to the pioneer days. In fact many times I feel like telling anyone who came after 1717 to go home. You immigrant bastards.

We were wrong, African Pride, and we apologize.

Sheltowee, get a grip. The whole “everyone but the Native Americans is an immigrant” thing is pointless. One, there are no indigenous peoples to the Americas. The so-called Native Americans came over from Asia across the Bering Strait. And the Mexican population is an amalgamation of peoples from various Native American tribes, to Aztecs, probably some Incans up from South America, people brought over from Africa, etc. Mexico is as much a melting pot as the US. Two, the USA has been around a couple hundred years, and the last war with the Native Americans was almost 100 years ago – time to get over it. And three, we’re talking about legal issues, not moral issues. And we’re talking about issues happening now. While the worker was due workers’ comp coverage for the injury, there must also be a reckoning for his and the employer’s illegal actions.

Pablo, I’d like to say I’m sure the worker’s wages were taxed, but you never know. If the employer didn’t pay for workers’ comp like he was supposed to it’s hard to say what else he didn’t do like he was supposed to.

    I apologize for any typos.

A racist will make racist remarks but will typically say “I was only kidding” and “I’m misunderstood”. If you don’t think what you say is a reflection of your true self (kidding or not) then you are living in denial. You could say “I was just lying in order to make you angry”.

This is my last comment and I won’t be back to view your response, so don’t bother. I hope God opens your eyes. I truly mean that.

This whole situation makes me wonder; was the injury really an accident?

Or was it really a plot to maximize his ill gotten gain before returning to the bowels of Tiajuana with his wad of untaxed swag.

That’s right boys and girls; you are not taxed if you are not here legally. Even the IRS’s hypocracy only goes so far.

I bet he had some weird facial deformity already; an ailment to Baja-dwellers almost as common as being short. This would have given him motive to perpetrate this foul plot in order to gain funds to have the renouned Tiajuana doctor, Dr. Juan Hunglow Martinez Hernandez Cocaroacha, reconstruct his face to look just like Antonio Banderas. WIth the intent of returning illegally to the U.S. to pursue an illustrous career as a voice over artist for animated fencing cats that dress like Zorro.

    What…..it could happen.

My history is correct and maybe you should read the Life of Daniel Boone – Draper Collection or the Master of the Wilderness by John Bakeless. And as far as Moral or Legal issues. If all of our laws were created as a result of a moral issue we would be living in a much better place. Thank God that it is illegal to murder someone.

Reason, your comment could have been construed as extremely racist – but was so over the top it was funny. That’s the sort of thing that goes to SNL for a skit. Wait, you’d have to strike and wouldn’t get a dime. Oh well, at least I get to enjoy the funny stuff.

Oh, and Sheltowee, I’m no racist I just have a sense of humor.

This country has allowed illegals to come through its borders. We have done nothing to stop it. Employers hire them to make bigger profits. In Oklahoma we finally passed a bill HB1804. That has begun to rid us of the ones that here illegally. Dont get me wrong there are some that are here in our country that really want to change thier lives for the better, by having respect for Our flag and Our Laws. Then their are those who break every law they can. Learn English and Become part of America, dont bring your Mexican Flag with you. I would never go to Mexico with an American Flag. I would respect their laws. I have seen it first hand, being in rallys and having, My Flag dragged and burned, that is not showing respect and that is why in Oklahoma HB 1804 passed. Thanks. Also can you all define prejudice and racist.

The first step in solving the illegal immigration is to simplify and speed up the process of legal immigration. Give the “illegals” that want to work for an honest wage individual identity. You can then focus on the criminals who do not want legal status. I suspect most employers won’t be anxious to higher thugs and murderers to work at any wage.

Another thing, we are all human beings and you are a racist if you consider any other ethnic group inferior to your own.

The Flag is symbolic of freedom, give that to people and they will embrace any flag that represents this.

Speaking of symbolism what does the Statue of Liberty represent to our country?
