Most states only require 25/50 minimum limits. Plaxico is(was) paid millions. Regardless of whether or not an underling was supposed to pay the bill, the ultimate responsibility lies with the insured. Try telling the IRS that your accountant didn’t pay your taxes and therefore it is not your fault. Try telling the mortgage company that your agent didn’t pay your mortgage while they are foreclosing on the home. The excuse that he “didn’t know” will not hold up in court. The ultimate responsibility for his affairs lies with him and him alone, end of story. At the very least he is responsible for hiring competent employees, which of course comes back to him.
Since the Giants are actually in New Jersey, perhaps Burress has (or had) a NJ pers auto policy w/ Allstate. In which case, standard coverage in NJ is 15/30/5. But you can also purchase “basic” coverage here, which is 0/0/5 (zero BI, $5,000 PD). Basic coverage was introduced by the State of NJ as an attempt to get all the uninsured motorists here to at least buy something.
Thanks for the Ins 101 lesson! I can tell you that if the policy was cancelled for non pay, and not every effort by the broker was made to make sure that it was paid that shame on him!! Hopefully Plaxico gets an agent that provides better service then the dope he has now!!

Tar, I think folks are referring to his sports agent drew rosenhaus, not his insurance agent – The insurance agent would not have access to Mr Burress’s funds in order to pay the bill, but his sports agent would.
Oh GIVE ME A BREAK – it IS NOT an agents job to call each client that doesn’t pay their bill – If you don’t pay your electric bill, they turn off your power. If you don’t pay your insurance bill, you have no coverage. It’s called RESPONSIBILITY – and he needs to get some – oh yeah i forgot he’s the the one who shot himself – bet his momma’s sooooooo proud……………….

There was a failry lengthy discussion on IJ somewhere regarding the issue of calling non-pay clients and whether it can spark an E&O claim or not. The consensus seemed to be split 50/50 as to the issue. I would think however that a good attorney could make the case that if it is your agency policy to personally telephone each client who falls behind on payments and have done so consistently and then fail to do so resulting in a denied claim, you could be held to be liable. This could be why most other businesses do not call and only send past due notices by mail.
I deal with people like this all day every day. I have even heard one say “well i knew my payment was due but you didn’t call me…” therefore their insurance lapsed. People need to wake up & take responsibility for their own actions. If you own a care, then you must pay for insurance. Period! I hope the judge throws the book at him. Moron.
Yeah, the guy was dumb for letting his insurance lapse; however, for those saying that the judge should throw the book at him, for what? Rear ending the lady? Pay the cost of the car bill and move on.
Unfortunately though, the lady found out that she was hit by a rich athlete and will likely be suing for a large amount of money that is well in excess of the damages for the accident.
The problem with this scenario is Plax, it’s the legal system and the people who use it as a crutch because they are too lazy to do anything for themselves. At least Plax is out there doing something.
