That’s tragic. I don’t blame VW unless they were negligent in regulations of roof strength but that’s still aweful. I don’t don’t blame the guy for trying to sue them. I probably would sue anyone with deep pockets I could in that situation or at least want to.
It good to finally see a realistic decision.As far as WOW who would also sue VW even though there was no liability on their part, would you take the same stand if you had to pay thier expenses when you lost?
I have never seen any claim when any participant in the claim actually came out and admitted that they were wrong.
We need to re-evaluate our antiquated legal system that is sorely skewed to the plaintiff who has no skin in the game. English law requires a plaintiff to pay the defendants expenese if he loses the case. Our system is a lottery where plaintiffs and attorneys have nothing to lose and everything to gain by filing suits. Usually our court system loses sight of liability and awards big sympathy bucks. Glad it didn’t happen here.
And I hope you don’t mind paying double and triple for things now because the “cost of doing business” in the US is out of control because of groundless suits like this one. For anyone who knows about this accident, “aggressive driving” is being very kind to describe what happened. Guess I should be happy though…more suits means people need to buy my insurance product!!

…that kind of thinking is what hurts the economy. Doctors have to pay rediculous malpractice insurance fees because of how many people think that way (which drives up medical costs). Professionals have to pay huge E&O insurance fees, corporations have to pay huge product liability insurance fees (which drive up consumer costs, stiffle investment and growth and curtail available fund that could be used for growth and job expansion). Courts get backed up trying to deal with the flood of frivilous lawsuits which prevents “real” cases from being heard.
Every accident is not a pay day opportunity. Sad, maybe, but not an opportunity to seek out who can be sued.
According the story the person driving was negligent (read: liable)… that’s who should be sued. If she doesn’t have enough assets/insurance to pay for the damages you’re out of luck.
Veedub might be guilty of building some of the worst quality/unreliable cars on the planet but they are not guilty in this instance. Clearly this woman doesn’t know how to drive and is to blame. That’s evidenced by the fact she managed to flip a freaking sedan over twice. You have to try to flip a sedan like a jetta over. I feel bad for the friend but it’s just another tough life lesson i suppose. Next time don’t drive like an idiot and maybe this won’t happen.
