the state knew that it did not have money for the cleanup. it wanted to go after anyone who could cough it up. problem, they did not resolve is the cost of court in the process. they should have thought of that. it already looks like they are in the hole for the other incidences. sounds like the state, needs to figure out why they don’t have enough insurance to cover it’s losses. yet, they require us to have insurance on our cars. they require business to have insurance. so why not the state? does it not have enough? um..um… sounds like a bad budget!
so was this a frivilous lawsuit?! question of the day — it is now costing them lots of money!
Should the courts rule that the defendants are entitled to reinbursement – which I believe they are – I hope that Motley Rice is forced to pick up the majority of the bill via their contract to pay for the case in exchange for 17% of the verdict. This entire situation wouldn’t exist in the first place if it weren’t for the likes of the money grubbing high-end ambulence chasers like Motly Rice. They invented the whole PN theory against the lead industry and went out peddling it to any AG they could, like the snake oil salesmen they are. Besides, Motly Rice can most definately afford to compensate the defendants (probably w/o even noticing the dent) while the state cannot.
It wasn’t the lead paint that had me seeing red it was how the stimulus money was directed “The situation is so dire that Gov. Don Carcieri in January proposed delaying payment of a $10 million legal settlement to survivors and victims’ relatives of a 2003 nightclub fire, before deciding this month that it should be covered by federal stimulus funds.” I guess George Bush started the Rhode Island fire as it is Obama’s contention that the previous administration created the obligations for his current appropriation bills. The states are using stimulus money to pay past due bills but doing nothing to fix problems going forward, including stimulating the economy. I’m fed up with political arrogance and condescension.

i agree, we as taxpayers should not see our money going for past due bills. that should have been in their coffers to pay for or have insurance for…..
where’s the lawsuit from a taxpayer?!
