    Why allow the dunes when they know Uncle Sam will be there to bail them out once again if they flood. Refuse them coverage under the National Flood Insurance program if they don’t comply and ban them from receiving any Federal freebies in the event of a storm loss and see how fast they say “ok” to the dunes!

      That’s not the point – the owners refuse to sign over their beach to the government. They’ll take the sand dunes, but they want to keep their land.

    Ownership of beachfront property should not be a perpetual entitlement to a specific piece of geography. If it washes away then go chase after it. If it washes away and takes out a neighbors property because the site wasn’t buffered, then there should be an assumption of liability by the current beachfront owner for knowingly denying access.

    And I suppose NJ has zero riparian rights.

    “Christie has vowed the state will use eminent domain to seize the land if they don’t sign.”

    That’s horrible. The state is basically saying “we’re going to take your land – it doesn’t matter what you do, we’re getting your land. Either you sell it to us or we take it and don’t pay you.”

    Eminent domain is an oft-abused government power, and it looks like it’s being abused in this situation too.
