NYC Reaches $5.9M Settlement in Eric Garner Chokehold Death Case

    The article said..”Garner, 43, was killed during a confrontation with Daniel Pantaleo and other officers on a Staten Island sidewalk July 17 over the sale of untaxed loose cigarettes. A widely circulated video of the incident showed Pantaleo applying a chokehold, which is prohibited by the New York City Police Department.”

    First, Mr. Garner DIED (wasn’t KILLED) during the altercation. Using “killed” makes it sound intentional, which it wasn’t.

    Second, the alleged “chokehold” was not proven to be illegal nor prohibited.

    The poor man died because he resisted the arrest and had severe asthma and other health conditions. It was an unnecessary tragedy and preventable IF Mr. Garner would have complied with the police’s request to allow them to arrest him.

    I’m assuming they settled, without admission of guilt, for at least two reasons:

    1) They would not be able to find an unbiased jury,
    2) The $5.9MM is probably significantly less than the damage that would be caused if they actually won the jury trial and risked NYC being burned down.

    The “silent” message here is that unarmed people are allowed to resist all they want to because the police are not allowed to use force to subdue them. The rule of law continues to be eroded.

      You are right of course. The deaths we have had with Police were all confrontations, resisting arrest and even attacking Police. Now, the cops in Baltimore don’t even bother to go to violent areas and only take the body bags out to haul away the deceased. They don’t want to be charged with murder. We live in anarchy in many cities. How many shootings does Chicago have in a typical weekend?

        I don;t know but 7 were killed and 55 injured over the 4th of July weekend.

        As you know, Chicago has the toughest gun laws in the country. Another example that it is not the law that gets guns off the street but the ENFORCEMENT of the law.

        Obama should try ENFORCING the immigration laws.

    If we really want to put an end to the nationwide problem of police brutality and to show the public that police, mean it when they say protect and serve, now is the time to mandate body cams.
    Of course that is not even on the table with the NYPD, as this town & the NYS prosecutors & courts are controlled by the police union.
