I wondered that too, Agent, but the claimant is going up against two parties, one of which is not his employer (?) I hate to see his WC claim award reduced by legal expenses.
ME does have a WC board…They’ve been harassing me for weeks to update our companies WC claims contact info, though I keep reminding them we terminated that line of business in 2011…it’s taken 3 weeks and multiple analyst, right up to their Deputy Director to get them to update their licensing system. So I’m not sure how good they can be over there. LOL
From the little detail in the article I have to assume this comes under the Jones Act, not standard WC. I believe under that act there is allowed as tort remedy.

Loss was on a boat. Coverage may be maritime in nature, outside the scope of statutory WC. Not much info in the article.
