Whatever happened to \”Use at your own risk\”? Maybe the state can take some of the overpaid politicians and lawyers salaries to pay for the insurance…. Or take their ENTIRE salaries and pay for the lawsuits.
Why don\’t they just pass legislation stating ALL parks must be entirely constructed of silicone rubber? (They could even get enviro-friendly and obtain recycled silicone from Hollywood.) The legislation should include a clause that states anyone entering the park may only do so if they are encased in an inflated bubble. No sledding. No skating. No running, walking the dog, bicycling, swing sets or merry-go-rounds. Only bouncing… in one place… 10 feet away from any other person… for 15 minutes… then go home.
Is this what it\’s coming to?
The two of you clearly have your heads on straight, good points made. Where are the rest of the people in this world with common sense and personal responsibility for their own actions and their own kids\’ actions?
Neb. Supreme Court ruling makes sense, but how do the Cities and Towns protect themselves. They will need to:
1.Fence the entire skate Parks &
2.Hirer Personnel to operate the Parks &
3.Charge a Fee to use the Park that Taxpayers paid for. &
4.Obtain a Hold Harmless Agreement from each Parent. OR
5.CLOSE THE PARKS!
These seem to be the alternative they face to transfer the Risk.
Sounds like the NE legislatured needs to step up and pass some recreational immunities statutes to provide some protection.
