That is sad. I’m just waiting for an insurance company to get the crap sued out of them for failing to allow a medical test or treatment to someone because it’s not medically necessary in their “expert” opinions. The small amount of money insurance companies save from denying test and treatments, cannot offset the amount they pay these companies to review the tests and treatments, but definitely not when a death or something like this happens.
It wasn’t that a test wasn’t completed. This doctor made a judgment call on the information that was available. The jury decided that since the patient wasn’t given all of her options that the doctor was at fault – even though if the doctor would have given her all the options, she would likely have still gone with the treatment. Doctors are not perfect. They can’t just hook up a monitor and say this is exactly what is wrong with you. The jury awarded her a huge sum of money because of her outcome rather than the doctor’s negligence. It was the wrong verdict but you can’t change that. What will be interesting is if the malpractice caps stand.
