I am certainly cognizant of the care, custody and control exclusions. My point was that the development is a $350 million project and the downwind homes damaged or destroyed were each mostly north of $500K. If the broker who placed the CGL risk didn’t address this type of loss, I would hope his/her E @ O coverage is adequate.
Whether the welder was a sub-contractor or in fact employed by Titan Builders, LLC, it looks like the adjuster who finds this loss on his desk might have to go up the food chain to get settlement authority.
