U.S. Doctors Say Lawsuits Help Guarantee Drug Safety

    (I’m just being sarcastic here)

    It sounds like the doctors just want somebody else on the hook for the lawsuits. “Please, sue the drug maker. My malpractice insurance is high enough. They have deeper pockets.”

    I don’t know enough about the process for approving a drug or its labeling to comment properly on whether the FDA is in the best position to decide these matters or if lawsuits are a valuable tool for the FDA. I just felt like being snarky.

    AMEN! Maybe lawsuits make doctors safer too but they all voted for Prop 12 in Texas (putting a cap on damages.)

    Approximately 50% of patients have adverse reactions to phenergan, especially the elderly. Shame on Wyeth for manufacturing it but more so, same on doctors for prescribing it. If they didn’t prescribe, Wyeth would stop manufacturing.

    It would take forever and cost us (taxpayers) a lot of money if it was purely up to the FDA to guarantee drug safety. Allowing the drug manufacturers to hide behind the FDA does not sound like a good idea to me.

    Caps on damages are no guarantee. Caps can be circumvented by a court ruling them unconstitutional. Might want to research how they worked in Wisconsin?
