Miners’ Union Takes Unusual Legal Turn to Save Benefits in Bankruptcy

    I hope the union wins it’s case against peabody! Peabody Coal got rich off the backs of hard working men and women and now they are trying to dump their responsibilties! My father went to work in the coal mines as soon as he graduated high school and he retired from the mines. It’s not like working at other places, when you work in a coal mine you are destroying your back, knees, neck, lungs, and risking your life everytime you go miles underground! And now Peabody just wants to cast them in the trash like they are nothing!! It is not right, it is not moral, and I pray they (Peabody) lose!!

    I would hope the case survives at least into the Discovery stage.

    Records of Peabody, i.e. corporate committee meeting minutes, emails etc. might shed light as to the real intent of the spin-off.

    If there are triable issues, let a jury decide.
