I instantly thought of a secondary comment; states who are attempting this tactic will fail, and they know it, so they are likely trying to coerce the insurance industry to provide a (small?) concession through legal strong-arm tactics. That is a clear, abhorrent abuse of the legal system.
If this issue of retro-actively legislating contract law reaches the SCOTUS, it will fail.
