Revised Kentucky Accident Victim Solicitation Law Under Fire, Again

    Quite frankly, I’m not sure why a police report with names, addresses, telephone, DL/DMV and quite possibly insurance information needs to be a matter of public record? What about the duty to protect someone’s personally identifiable information?

    Now you know why there are lawyer commercials every 5 seconds here on TV. One of the TV commercials looks like a lawyer when in reality it’s a Florida based chiropractor in sheep’s clothing. They go by nicknames like, “The Hammer” and “The Tiger” with another Florida based law firm going by the slogan, “For the People”. Yeah right. One in particular supposedly has never tried a case because these fake lawsuits are such a slam dunk and settle out of court. They target the “have nots” who live by milking the system for all they can get. The result, as usual, is the good people pay higher rates to subsidize the leeches and fat cats. I had asked the Big “I” once about trying to address this abuse with the state legislature. They just laughed at me because this “good ol’ boy” state is run by lawyers and liberals. So the good people of Kentucky are destined to ongoing financial struggles in one of the poorest states while the “sharks” continue to go in for the kill.

      I hear you, but general advertising isn’t ambulance chasing. The targets here are the ones who show up at your door or in your hospital room (i.e., direct contact) after having mined your name from an accident report that is considered public record.

        Sure it is as demonstrated by the ad frequency and when the message is, “Don’t let the insurance companies push you around”. One lawyer’s ad said, “We’ll get you more than you deserve”. That “more than you deserve” line says it all. But my point is that these “thick as thieves” are thicker than most places because the pickin’s are so good thanks to the PIP laws regardless of how they get clients. The fact that they can afford expensive TV ads every 5 seconds is a measurement of how lucrative it is. If I was them, I’d do the same thing to line my pockets because they have made their scheme legal and from what I can tell, it will never change. It’s a nice setup when you are on the receiving end.
