    This is the only case that I’m aware of in Georgia in which the company, in addition to the driver, has been indicted for vehicular homicide. This is going to be very interesting to see how it wraps up. The civil penalties are an incentive to change, but the possibility of criminal penalties will really help move this industry in the right direction.

    With the likelihood of a punitive damage count on all lawsuits, this accident would appear to have creted $60 to $100 million in potential claims. Since this a large trucking company, how is excess liability coverage provided? Is it common for carriers to provide $100+ million in the admitted market? Do trucking companies typically carry sufficient coverage for this type of loss? Does stop loss reinsurance get triggered on this size of claim?
