South Carolina Nursing Home Accused of Negligence After Resident Drowns in Puddle

    Although this individual needed nursing care it would appear that he was able to make a decision for himself and if that is correct then where is the negligence. This was not a child but rather a grown man who was asked to come back inside. If he choose not to then at that point he assumed responsibility for his own safety and well being.

    Had the nurse forced him to come in I would think that this would be a criminal act.

      That’s nonsense, Bob. He was in the nursing home because he was unable to care for himself. The family paid the nursing home to take care of him, and they were negligent to allow a man who cannot take care of himself make clearly dangerous decisions on his own.

        It is just the attitude that no one is responsible for themselves any more that is one of the most serious problems with America. If the patient was well enough to continue to smoke cigarettes some how I feel that he was well enough to make a decision for himself. He was a patient not an inmate and along with that comes personal responsibility as well.

        Had the staff member left him and forgot him well then it would certainly be different but in this case the staff member attempted to get him to voluntarily come in so please take your “nonsense” comment and do with it as you please.

    All Residents, competent or not, that reside in nursing homes have civil rights and residents can’t be forced to do anything, even if it’s in their best interest. You can not medicate against anyone’s will, stop them from walking out of the building, or make them go to bed, or even stop smoking.
