Court: Farmers Insurance Broke Law, Can Keep Money

    There is the right way and the legal way. Add this to the pile already created about Farmers. The honorable thing to do would be to offer the return of the amounts charged as a credit on future bills. Then again there is the legal way

    Hey,just call it even for the numerous frivolous lawsuits insurance companies pay out on to avoid the higher cost of litigation and the even more ridiculous jury awards.

    Besides, look at the bright side….who really got screwed here??

    This makes no sense to me. Why wouldn’t they have to return it, especially in California? Unjust enrichment?

    I’m no lawyer, but my guess would be that the fee itself wasn’t illegal, it just wasn’t disclosed properly.

    well, if that is the case, when you purchase fuel from the gas station, how much of that is being taxed for what purpose? it’s not being disclosed? there is a combination of taxing on fuel and many other items. so can we sue the ca gov and then the many facilities for the taxing that has not been disclosed? um..um… sounds like the state needs to look at this again… or possibly give the money back to the folks of california.

    The $5.00 charge by FIG was shown on the insured’s bill, I have examples of the bills in my office showing this. I don’t know where this came from since we have always called this a “service charge” and clearly indicated that to the insured. Perhaps some attorney found a flaw in the spelling of “service”.

    Uh, they do disclose gas taxes. Not on your receipt or on the big sign w/the prices, but if you go to the little booth or go inside, there’s always a little sticker somewhere showing how much per gallon is for fed/state taxes…

    Out of curiosity, does the service charge appear on any documentation presented to the insured when the insured selects billing options?

    but if i pay at the pump, how is that helping me? if i buy something from the store, like cigarettes, most of that has taxes added for a variety of funding. do you see that listed anywhere?

    see if it works to catch the civilian world, then they we allow the g’vt to sue and get money…but if want to see what the g’vt is taxing, we don’t see it in writing anywhere (everyday/every sale).. so who is hiding what or whom?

    Yes, the insured is given a bill that has two parts, one is sent with the payment and the other has when the second half is due with the service charge for the split payment option. Perhaps something else that I am not aware of exists to create the need for this type of lawsuit, like deep pockets!

    ok what does GAS tax have to do with a service charge? someome please expalin this to me ! none dicscolsure is the same as fraud !! what other laws have they broken? and gotten away with ?

    Yes, the monthly billing agreement states there will be a service charge. It’s not always $5.00 but varies depending on the total monthly premium.
