It leapt out of the darkness and stalked him. You never know where trains will try to get you, except for those silly tracks they leave all over. Train car accidents are terrible, but they happen because drivers don’t pay attention. I stop and look whenever crossing a track. common sense is not common these days.

We need to move EVERYTHING that is on the “other side of the tracks” so that none of us has to “CROSS THE TRACKS”.

That should take are of this exposure!!!!!

It’s all the transfer stations fault!!!

Question what was the Father in law taking to the transfer station? I think we need to sue them also!!!!

Oh and the paving contractor who paved the road leading across the tracks.yep add them to the list!

Amtrak should counter sue for damage to it’s train caused by the negligent operation of the motor vehicle. This bustline wasteland with a population of 14,565 should be the LAST place to get whacked by a train. Sounds like the guy was too busy listening to AM radio in his pick-up to think there’d be a train in the middle of nowhere. He should have had some “driver TRAINING”.

You all have been in the insurance business too long. Dufus? He was an important part of someone’s family. Instead of calling him names or blaming him, how about some compassion for him and is family? After all, he is dead. Let’s see how much blame we can place on a dead person right? Not always are the defendents and insurance companies being taken advantage of.

Certainly, but we are also entitled to wonder why the individual couldn’t see that there were tracks that might have a huge metal monster rolling along them. A monster that takes a couple miles to stop. A car or truck takes a lot less. I have a relative who drives these trains and is in mortal fear of killing someone like this. People are in too much of a hurry to slow down or stop anywhere any more. How isn’t that the case here? Just because there may not be a gate or even a stop sign there is no cause to just proceed. Car + train = death. I’m not being sarcastic at all. I just don’t understand drivers who ignore that equation.

Even left work, driven half way home and realize you don’t remember how you got where you are? Ever drive with your windows up and your radio on? I have lived in my home for a long time and have railroad tracks with a few hundred feet. After a few days you tune out the noise. To error is human.

To err on a railroad crossing is to have a death wish. I certainly have had those moments too, but not when I come to unmarked crossings. I’ve seen a couple car train accidents in person and that gives incentive to pay attention. This is another case of people trying to pass off their lack of personal responsibility to some other party. Preferrably a party with a lot of money. I remember the interview done with a train engineer after a wreck where he could only look into the eyes of the person his train was about to kill after they tried to beat the train. I have a lot more sympathy for that engineer than I do the drivers who try to win the race.

Agreed, As a E.M.S. person I’ve been to a few of these.Always seem those damn trains always are the cause by racing down the tracks at all hours of the day.Even had one where a Teen ager tried to grab a Amtrak doing 70 m.p.h. and lost his arm, had his left leg mangled like a pork loin and luckily survived .Tried to sue and lost.A trucker tried to pull onto a property and the train got it and shredded paper was falling like snow.
    Gotta watch those damn trains
