Arizona Appeals Court: Architect Can Be Sued for Negligence

    sounds like more business.

    but, more than that… sounds like a reasonable expectation of the consumer. you’d think it would be plausable that the designer would follow all laws and construction codes when designing your structure.

    and should be paid by the E & O carrier (if they have one, LOL).

    While it may be nice to sue the architect on this one:

    1. The issue arose 8 years after the fact.
    2. The complex had to have had approval of the city planning and zoning department before and during its construction
    3. The city building department would have inspected the property several times during its construction for code compliance.
    4. The plans would have been submitted to the city for review and approval before the first shovel of dirt was even allowed to be dug.

    An Architect will design a building that looks like a hot dog on a bun if you contract them to. That doesn’t mean the city will let you build it, or if they do,
    they will tell you how many handcapped parking spaces you must provide.

    The city is the culprit here.

    i think the city and the architect are both to blame. but who called this one after 8 yrs? the feds or city? don’t blame the landlord for he complied and built it like the architect said. he’s the professional and should know the laws and codes. the builder should have been the secondary one to know the codes as well. but most importantly, the city inspectors, because they had to approve of the plans and make the inspections along the way.
