It is good to see those criminals get caught. They make it hard for the rest of us injured workers to get adequate help with our claims. However, what happens when the employer commits fraud? I know of fraudulent acts committed against me, in retaliation for being involved in the workers’ comp system. My employer is self insured and has committed perjury by way of their attorney, ex parte communication with the PQME, PQME attempted to alter my medical files, to create an exaggerated level of impairment, to prevent me from returning to work, and a low enough rating to keep them from having to pay me PD. I have documented proof of EVERYTHING, and the MDR Courts are trying not to get involved, because they don’t want to have to make a ruling against the self insured employer. All we hear about is how the injured workers’ commit fraud and how they get caught, and how bad it make the system… but what about people like my employer who’s penal code, civil code, and labor code violations get overlooked and the damage to the integrity of the system is blamed on us, the employee.
