i can see an issue w/the employee… how was she in contact with the so-called bodily fluids? how do we know that it was not some way done outside of work? is this virus have a dna attached? if not, how is she going to prove otherwise? how is going to show that she followed proper procedures? if she was a nurse, did she use gloves? any other precautionary members that she did not use…. to me this sounds like a case of getting money to help w/the child… it be like me stating i have got the measles and my son/dau was affected by it, but i am going after the whomever i had contact with that had it… it does not make any sense…
could you not expect, that some of the consequences are from smoking, not eating properly, taking certain medications. it could be a genetic thing as well. so many things could have contributed for this. although it’s going to be tough not just $$ but emotionally as well. there’s a lot of things that can get this tossed out, because she needs to show a specific detail of where/when and proof that she contributed w/in reason those things shortly after contact w/her medical review that she should have gotten while being pregnant.
Very sad for the parents and child but it would take an extreme amount of proof to get me to buy that the employer is responsible.

Aren’t communicable diseases (common colds, chicken pox, HIV) excluded from policies?
