    Somehow I don’t remember seeing any convicts doing hard labor, breaking rocks and wearing safety goggles either. Would he have expected to be given a ‘cup’ if he got clocked elsewhere?

    Not to be the dull insurance guy here, and discounting the obvious clown factor, but most states I’m familiar with consider court mandated community service workers to be statutory employees (of the County, in this case) for purposes of Work Comp. Is that not the law in Oregon? Which would prevent any tort action from getting very far.

      Didn’t know that. I would be interested to see what comes about this, but I’m sure we’ll never hear anymore about it.

    The supervisor may be guilty of misjudgment (the order to break the tree with your bare hands may have been ill advised depending on a wide variety of factors), but I have a tendency to believe that criminals really ought to pay the price for their crimes — even unexpected ones.
