“Judge has awarded $80 million?” Bench trial? I would have rolled the dice with a jury!
Anyway, judgments like this should help the PC industry in selling higher CGL and Commerical Auto limits. Looks like the price of wrongful death claims is going up!
I have a general question. Here in Canada, we have a cap on general damages for pain and suffering at about $348,000. So even in cases of severe brain injury or paralysis to a young professional who will need 24/7 care and never work again, judgments are usually under $10,000,000. How do awards in the $80,000,000 range get calculated, and how do the liable parties pay this? I can’t imagine liability limits are that high?? Can someone help me understand this? Thanks.
