Workers’ Comp Study: California Reforms Lowered Medical Payments Per Claim

    I have treated injured workers for many years and I have finally given up dealing with this very broken and corrupt system. It is criminal how so many people’s lives are ruined by the ridiculous games played by the insurance and these poor patients are trapped and cannot seek care elsewhere. I have told all my patient that I am leaving the system by then end of the year, I have further advised all patient to see about filing a class action suit against all the different W/C insurances and the state of California. Remember the next person to be abused by the insurance may be a loved one of yours.

    Without naming companies, can you give examples of the abuse that you cite? I have heard these claims, but not witnessed them. I have been an adjuster for years and now train in the industry. I would campaign against abuse. I don’t think that it is a majority of insurers, but I could be wrong. Is this just a California issue? Have you seen it elsewhere? Without any specifics, these are just claims by one person that we (fellow readers & mostly insurance people) cannot quantify nor verify. This gives us no credibility in an argument against a system.

    Yes there is some good, but the bad out weighs the good. And our workcomp systems coupled with stacked state med tort laws, are allowing big insurers to fleece labor and pateints in our comp care and our HMO care as well. Dr.s alllowed to harm on sniffs and grins, then hide behind med tort laws for their crimes to humanity.

    Weather done for the insurers bottom line, or to push a bias social moral pursit breed agenda into our care, all on sniff, sneers and grins, withn bias moral pens.

    One class harming another, not on objective medical evidence, but gut instincts, an bais asumptions, that create harm to the very patients these folks have a duty to do no harm to, but do, then hide behend med tort laws for ever.

    Their then victims must take decades to get justice, if they ever do.

    This pits dr.s against pts and has resulted in death.

    This is bad public safty polcy that is only harming some while others are getting rich off the deal, or lack of one as it now sits for most low line laborers who get cheated out of the goods and services we and our employers piad for, here in WA State. This is nothing but a silent back door class war on the aging injured working infrim and poor, but elite snobs, many of whome, have never toiled a day in their lives to survie. SAD country we now have do to this very root cuase to ineqaulty in our world today. Elite profiteering purist breed whores. In other words, NAZI’s.

    For instance, as an example, say you are injured, and the doctor prescribes you medication or treatment. The company, (or insurance company, if they are not self-insured) may deny that medication, and then the PATIENT must appeal, while the treating physician cannot advocate for you. Your lawyer cannot help you. And then the appeal is upheld by vague citing of medical guidelines, out of context (Yes I downloaded the 50 pages of the regulations of California utilization review policies and the specific guidelines for medical treatment) Given by a doctor who has never met the patient, and can arbitrarily ignote any data of the patient’s medical history. THEN l, the patient is left out in the cold. What happens after that? Many turn to the state for medical care. Even on a financial level, not even a moral and “the backers of this system crawled up Satan’s scurvy hole” the state now carries what insurance won’t.

    Insurance now can dictate how much it will pay for a patient, and what a patient needs for care. A BUSINESS playing doctor. And companies won’t argue that, cause they pay less.

    I guarantee you the PATIENTS, the ones who have to deal with this stupid reform, are not waving their hands in joy, and patting the lawmakers on the back. But THEY don’t have a choice to fight unfair manipulation of the system. Whatever “money” is saved is paid on the backs of the patients who can now have their treatment cut for no reason and can do nothing to fight it. I know, I fought for my father, I appealed to the state, the senators, the governor, the state reps, the california labor board, everybody, and met with “wheeelp, them the breaks.”

    The only people praising this reform are the ones who don’t have to suffer under it.

    The crime here is anybody believing that insurance companies and businesses operate with any integrity.
