Personally, I have not used Uber that often. But everytime I did my driver was simultaneously running Lyft. My employer doesn’t allow me to moonlight for a competitor. If Uber drivers receive employee status it will certainly come with consequences. I realize that isn’t necessrily a matter for the court, but I would say that the parties to the suit should be careful what they ask for, because they may get it at costs they wouldn’t have anticipated.
