Popular novelist Stephen King filed a lawsuit in a Maine Superior Court against his insurer, Commercial Union York Insurance Co. The suit alleges that the insurance company failed to provide full coverage for injuries King suffered as the result of being struck by a van nearly two years ago.
According to a report by the Associated Press, King and his wife, Tabitha, are seeking the $10 million limit of an umbrella policy plus interest of 1.5 percent per month. The Kings’ attorney Warren M. Silver stated that King’s physical and financial damages from the accident far exceed the amount the author is seeking in court.
In June 1999, while walking along the shoulder of Route 5 near his vacation home in western Maine, King, 53, was hit by a van driven by Bryan Smith. King’s injuries included a broken leg and hips, broken ribs, and a punctured lung. As a result, King has undergone five surgeries, and Silver indicated it is likely the writer will undergo another operation this summer.
Commercial Union York Insurance Co. has branches in the cities of Portland and Bangor in Maine.
