Shouldn’t the agent or lawyer be paying that bill?

If it was the players responsibility id be surprised.

A lot of the guys just dont have the mental capacity to pay their own bills and manage their finances.

Right on target with that comment. Many of these professional athletes are spoiled children. Not all of them, but enough to ruin the reputation of the rest. Told how special they are and that the rules of the rest don’t apply to them. Sad

And if he had Allstate, it had to be a minimum of 2 months behind before they cancel a policy…

But Plaxico was a graduate (or at least a student) at the Univ. of Michigan before entering the NFL. Got to have the basics of reading & writing don’t you?

    Keyword: Responsibility

Definition: That sense of which is missing from Mr. Burress. That lack of which is at the root of both the accidental shooting and lack of auto insurance.

Most states only require 25/50 minimum limits. Plaxico is(was) paid millions. Not a very smart move for someone with substantial assets but,if he can satisfy the basic FR requiremensts and goes without insurance it is no ones business but his. Same with his carrying a gun, as long as he shots only himself.

Regardless of whether or not an underling was supposed to pay the bill, the ultimate responsibility lies with the insured. Try telling the IRS that your accountant didn’t pay your taxes and therefore it is not your fault. Try telling the mortgage company that your agent didn’t pay your mortgage while they are foreclosing on the home. The excuse that he “didn’t know” will not hold up in court. The ultimate responsibility for his affairs lies with him and him alone, end of story. At the very least he is responsible for hiring competent employees, which of course comes back to him.

Since the Giants are actually in New Jersey, perhaps Burress has (or had) a NJ pers auto policy w/ Allstate. In which case, standard coverage in NJ is 15/30/5. But you can also purchase “basic” coverage here, which is 0/0/5 (zero BI, $5,000 PD). Basic coverage was introduced by the State of NJ as an attempt to get all the uninsured motorists here to at least buy something.

Hey, HA! Actually, if his agent Drew Rosenhaus made a practice of paying that bill for him, I believe Rosenhaus’s E&O would cover this auto claim.

Thanks for the Ins 101 lesson! I can tell you that if the policy was cancelled for non pay, and not every effort by the broker was made to make sure that it was paid that shame on him!! Hopefully Plaxico gets an agent that provides better service then the dope he has now!!

To: Mr Good Hands People: you don’t have to criticize Allstate..-that’s the “job” of 60 Minutes, CNN, NBC, etal

Allstate is what it is: a good company always striving to be a great company..-
And that’s more than lots of other carriers aspire to
-You ? You’re probably a guy who can go through a box of Kleenex overnight….-without having a cold.

Oh here we go, it’s the agents fault again. Didn’t take long to blame us for this idiots failure.
I’m also pissed because Burress’s actions have been a distraction for the team. But maybe it’s just the Giants fault for allowing this to happen. Poor Plaxico, he should not be held really to any standards, not even being an idiot!

Tar, I think folks are referring to his sports agent drew rosenhaus, not his insurance agent – The insurance agent would not have access to Mr Burress’s funds in order to pay the bill, but his sports agent would.

Oh GIVE ME A BREAK – it IS NOT an agents job to call each client that doesn’t pay their bill – If you don’t pay your electric bill, they turn off your power. If you don’t pay your insurance bill, you have no coverage. It’s called RESPONSIBILITY – and he needs to get some – oh yeah i forgot he’s the the one who shot himself – bet his momma’s sooooooo proud……………….

There was a failry lengthy discussion on IJ somewhere regarding the issue of calling non-pay clients and whether it can spark an E&O claim or not. The consensus seemed to be split 50/50 as to the issue. I would think however that a good attorney could make the case that if it is your agency policy to personally telephone each client who falls behind on payments and have done so consistently and then fail to do so resulting in a denied claim, you could be held to be liable. This could be why most other businesses do not call and only send past due notices by mail.

I deal with people like this all day every day. I have even heard one say “well i knew my payment was due but you didn’t call me…” therefore their insurance lapsed. People need to wake up & take responsibility for their own actions. If you own a care, then you must pay for insurance. Period! I hope the judge throws the book at him. Moron.

Yeah, the guy was dumb for letting his insurance lapse; however, for those saying that the judge should throw the book at him, for what? Rear ending the lady? Pay the cost of the car bill and move on.

Unfortunately though, the lady found out that she was hit by a rich athlete and will likely be suing for a large amount of money that is well in excess of the damages for the accident.

The problem with this scenario is Plax, it’s the legal system and the people who use it as a crutch because they are too lazy to do anything for themselves. At least Plax is out there doing something.
