This is BS..I work for a retail place and there are yellow stripes in the parking lot, painted STOP in the parking lot, arrows pointing which direction traffic is suppose to go and even NO Parking signs.But people still don’t follow the directions. People walking should have the right away, but I can tell you that some drivers just don’t care. The driver is at Fault he is the one who should be in court..Not Menards. Greedy lawyers
I think the responsibility is shared. Some people walk around in a parking lot like they have an invisible shield protecting them. Drivers should be held responsible but people who walk in front of a moving car always look for someone to blame. Menards isn’t the one to blame.
So, if someone jaywalks and gets hit by a car the city has the responsibility for this persons safety because they didn’t do enough to protect them from cars? At what point in time did personal responsibility disappear in America? Menards is not at fault in this case, not all details are given so there may be blame on both parties.
Perhaps the walker and the driver were both texting at the same time. Walkers will walk right into the traffic lane at the worst time and inattentive drivers will just keep on coming. It is not the stores responsibility to monitor the lot with a traffic cop out there.
Seems like the pick up driver had low or no limits of liability for his insurance coverage. So the attorneys go after the deeper pockets.
